If the customer is a consumer (i.e. a natural person who purchases the goods for purposes unrelated to any business or professional activity carried out, or does not make the purchase by indicating a VAT number reference in the order form), the purchases made on the website www.etereacosmesi.it are governed by the Italian law on distance selling (Legislative Decree No. 206 of 6 September 2005). Natural Cosmetic also complies with the obligations deriving from Legislative Decree 9 n. 70 of April 2003 (Implementation of Directive 2000/31/EC relating to certain legal aspects of information society services in the internal market, with particular reference to e-commerce).

The sale between Natural Cosmetic and the customer must be considered concluded when the order forwarded by the customer, in compliance with the purchase procedure specifically indicated on the website, reaches the address of the site itself. The order sent by the customer will be binding for Natural Cosmetic only if the entire purchase procedure has been completed regularly and correctly, without any evidence of error messages from the site. By submitting the purchase order, the customer acknowledges and declares having read all the information provided by the site during the online purchase procedure and fully accepting the general conditions of sale.

 

Method of purchase

 

The customer can only purchase the products present in the site catalogue at the time of placing the order, as described in the relative technical-information sheets. The order cannot be made in relation to products which, although present in the website's catalogue, are indicated as unavailable. In any case, the products on the website are offered until their availability lasts.

 

All products displayed on the site are understood to be available for immediate delivery, unless explicitly indicated otherwise. The sales prices displayed on the website www.etereacosmesi.it are to be understood as inclusive of VAT. The correct receipt of the order is confirmed by Natural Cosmetic SRL by means of a communication, sent via e-mail, to the e-mail address indicated by the customer in the purchase procedure. The confirmation communication will contain the order identification number, the date and time of placing the order, the indication of the products purchased, the price, the delivery costs and any cash on delivery, the data provided by the customer for the billing and delivery, the payment method chosen by the customer and a summary of the general conditions of sale. The customer must immediately verify the content of the communication and undertakes to verify the correctness of the data contained therein as well as to promptly communicate any errors and/or omissions. In the event of momentary outage or delay of a product, the customer will be promptly notified via e-mail.

 

Terms of payment

 

Each payment by the customer can only be made through one of the methods indicated on the website www.etereacosmesi.it

 

PayPal, by credit card and prepaid card.

 

The order amount will be charged to the customer's Paypal account after the order has been confirmed by Natural Cosmetic. The delivery of the product will be performed after the crediting of the purchase price has been verified in the PayPal account of Natural Cosmetic Srl. Any refunds to the customer will be made by Natural Cosmetic Srl. A confirmation email from PayPal will be sent to each transaction made.

 

Bank Transfer in advance

 

In case of payment by bank transfer, the execution of the delivery of what ordered by the customer will be kept suspended until the amount due has been credited to the bank account of Natural Cosmetic Srl. The transfer must be made by the customer within three working days of receiving the e-mail certifying receipt of the order and the customer must provide proof of the transfer order by sending a copy to Natural Cosmetic Srl by e-mail at info@etereacosmesi.it. The credit of the transferred amount to the Natural Cosmetic Srl account must take place within eight working days of receiving the e-mail certifying receipt of the order. Once one of the terms mentioned above has expired in vain, the order will be considered automatically cancelled and will not be processed. The purpose of the bank transfer must include: I) name and surname, company or corporate name of the holder of the order; II) the reference number of the order; III) the date of placing the order.

 

Cash on delivery

 

Cash on delivery is subject to the following conditions:

Payment must be made exclusively with banknotes (bank checks or cashier's checks are not accepted) directly to the courier upon delivery; Supplement of €5.00 on the total order.

 

Delivery methods and costs

 

Natural Cosmetic Srl will deliver the selected and purchased products by express courier to the address provided by the customer when ordering. Orders will be processed as soon as they are received. Natural Cosmetic Srl undertakes to deliver the products in the shortest possible time. The total amount of the expenses will be visible before proceeding with the purchase confirmation. The shipped goods will be checked and delivered to the shipper intact and without defects. Natural Cosmetic Srl cannot be held responsible in any way for any delays or damages attributable to the shipper's fault.

Shipment to Italy: Transport on Italian and European territory is entrusted to the best known and most reliable express courier. Delivery for Italy takes place within 24/48 hours, the times indicated above are absolutely indicative and may vary during holidays and/or according to the destination to be reached. In any case we are not responsible for any delays due to the courier. For transport on European territory, delivery times vary from 2 to 5 working days depending on the destination to be reached.

In order to have an accurate and safe delivery, please indicate the destination address as precisely as possible, complete with useful information, such as for example Staircase, Interior, Intercom, etc.

Associated with each order there will be a shipping code consisting of an identification number, that will be communicated via e-mail confirming the departure of the package from our warehouse, with which it will be possible to check, directly from the website of the courier, where the shipped package is.

Non-delivery due to absence of the recipient: If the recipient of the shipment is absent, the courier will leave a notice on the first attempted delivery and carry out a second one the following day. In case of absence of the recipient at the second attempted delivery, the goods go into storage. The storage service consists in the custody of shipments that have not been delivered for reasons beyond the courier's control. In the event of non-delivery, the goods are placed in special supervised areas with limited access. The service provides for communicating to the sender information regarding the storage and the request for redelivery shipments. The goods are returned to the sender if there are no new instructions within 10 working days from the opening date of the storage. All expenses relating to storage and redeliveries will be charged directly to the recipient.

The issuance of the invoice is not mandatory if it is not requested by the customer no later than the moment of execution of the operation, as indicated in the art. 22 of the Presidential Decree n. 633 of 26 October 1972. By sending the order to Natural Cosmetic Srl the customer agrees to receive the invoice/receipt in electronic format. The customer will be able to receive the invoice/receipt in paper format by expressly requesting it from Natural Cosmetic Srl. After the invoice has been issued, it will not be possible to make any changes to the data indicated in the same.

Right of withdrawal

 

The customer has the right to withdraw without any penalty and without specifying the reason, within the term of 14 (fourteen) working days from the day of receipt of the products, by sending a written communication by email to the address: info@etereacosmesi.it.

The communication referred to in the previous point must specify the intention to withdraw from the purchase and the product or products for which it intends to exercise the right of withdrawal, attaching a copy of the receipt/tax invoice. The customer must therefore return the product in its original packaging at its own expense to “NATURAL COSMETIC SRL”, Via Cupa II Traversa, snc 81030 San Marcellino (CE). The goods must be returned intact, in the original packaging, complete in all its parts and together with the tax-related documents.

Without prejudice to the right to verify compliance with the above, Natural Cosmetic Srl will re-credit the payment instrument used for payment to refund the amount of the products subject to withdrawal in the shortest possible time and in any case within a maximum period of 30 days from date on which it became aware of the exercise of the withdrawal. Natural Cosmetic srl has the right not to accept returned products that have been altered from their original condition or have been damaged. If the recipient of the products indicated in the order is different from the person who made the payment for these products, the amount paid corresponding to the returned items will be refunded by Natural Cosmetic srl to the person who made the payment. If the right of withdrawal is exercised, Natural Cosmetic srl will not be responsible for the transport costs for the return or for any loss or damage to the products attributable to third parties.

 

Responsibility

 

Natural Cosmetic Srl assumes no responsibility for disservices due to reasons of force majeure or unforeseeable circumstances, even when dependent on malfunctions and disservices of the Internet network, in the event that it is unable to execute the order within the time stipulated in the contract. Furthermore, Natural Cosmetic srl will not be responsible for damages, losses and costs suffered by the customer following the non-execution of the contract for reasons not attributable to the same, and unless they depend on the fact or omission of Natural Cosmetic srl, since the customer is only entitled to the full refund of the price paid and any accessory charges incurred.

Furthermore, Natural Cosmetic Srl cannot be held responsible for the information, data and any technical or other inaccuracies that could be contained in the site, if they have been communicated by third parties and have been verified by Natural Cosmetic srl according to the criteria of the ordinary diligence. Natural Cosmetic srl assumes no responsibility for any fraudulent or illegal use that may be made by third parties of credit cards, checks and other means of payment, upon payment of the purchased products, if it demonstrates that it has adopted all the possible precautions based on the best science and experience of the moment and on the basis of ordinary diligence.

 

Privacy and processing of personal data

 

The website www.etereacosmesi.it is accessible and navigable anonymously. All product sheets are freely available, a similar operating procedure applies to placing products in the shopping cart for proof of purchase and verification of shipping costs. Registration on the website is required at the time of purchase and it is required to enter the information strictly necessary for the purchase and delivery of the product. Within the registration form it will be possible to subscribe to the Newsletter to be periodically informed about promotions and offers. The data provided is subject to compliance with the law on the "Protection of the person and other subjects regarding the processing of personal data" (Legislative Decree 30.6.2003 n. 196), known as the Privacy Law.
